ORDINANCE NO. 2015-05

AN ORDINANCE ANNEXING CERTAIN TERRITORY INTO THE

CORPORATE LIMITS OF THE TOWN OF VERDIGRIS, OKLAHOMA, AS

MORE PARTICULARLY DESCRIBED HEREIN; REQUIRING A COPY OF THE

ORDINANCE AND CORRESPONDING MAP BE FILED WITH THE ROGERS

COUNTY CLERK; PROVIDING FOR SEVERABILITY; INCORPORATING THE

FINAL SERVICE PLAN ADOPTED BY THE TOWN BOARD OF TRUSTEES,

AND DECLARING THE SERVICE PLAN TO BE EFFECTIVE IMMEDIATELY

UPON ANNEXATION; DECLARING THIS ORDINANCE TO BE A PART OF

THE TOWN CODE; AND, DECLARING AN EMERGENCY.

WHEREAS, a municipal governing body by ordinance may add to the municipality territory

adjacent or contiguous to its corporate limits and increase or diminish the corporate limits as the governing body deems desirable for the benefit of the municipality;

WHEREAS, the Town Board of Trustees of the Town of Verdigris, Oklahoma (the "Board"), proposes to annex certain territory into the corporate limits of the Town of Verdigris, Oklahoma (the "Town"), pursuant to the specific provisions of Title 11 O.S. §§ 21-101 and 21-103, and for the reasons set forth herein;

WHEREAS, the Town Board has given notice, held a public hearing and took public comment regarding the annexation of the property annexed herein, all as required by law;

WHEREAS, the proposed territory is adjacent and contiguous to the Town, receives the same services as all other similar areas of the Town, and will continue to receive such services by the same methods and/or means, but in addition, will be provided with police protection services by the Town;

WHEREAS, the Board has determined that all the requisites to annexing the territory have been satisfied and met, all as required by law;

WHEREAS, the Board has determined it to be in the best interest of the Town to annex the

aforementioned territory;

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE

TOWN OF VERDIGRIS, OKLAHOMA, :

Section 1: That, pursuant to the laws made and provided by the State of Oklahoma, the real property hereinafter described may be lawfully annexed to the Town and, henceforth for all purposes, considered a part of the Town. Further, annexation is in the best interests of the Town, and in the best interest of the surrounding area and public at large.

Section 2: That the following described real property and premises, situated in Rogers County, Oklahoma, be and the same is hereby annexed to the Town of Verdigris, Oklahoma, to-wit:

SEE EXHIBIT “A” ATTACHED AND INCORPORATED HERETO

Section 3: That there shall be filed in the office of the County Clerk of Rogers County, Oklahoma, a true and certified copy of this Ordinance, together with an accurate map of the territory hereby annexed.

Section 4: If any section, subsection or sentence, clause or phrase of this Ordinance is for any reason held invalid, such decision or decisions shall not affect the validity of the remaining portions of this Ordinance.

Section 5: The Final Service Plan for Extending Services to Territory Proposed for Annexation adopted by the Town Board and on file with the Town Clerk is hereby incorporated by reference as if set forth fully herein. The implementation of the Final Service Plan shall be deemed immediate upon annexation.

 Section 6: The provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the Town of Verdigris, Oklahoma, and the sections of this Ordinance may be re-numbered to accomplish this intention.

Section 7. For the preservation of the public peace, health, welfare and safety, an emergency is hereby declared to exist and by reason whereof this Ordinance shall become effective immediately upon its passage, approval and publication as required by law.

PASSED AND APPROVED by unanimous vote, and the emergency clause passed and approved by a separate and unanimous vote this 16th day of July, 2015.

LANDS PROPOSED FOR ANNEXATION

  1.  EW 530 Road, from its intersection with NS 4140 Road, to its intersection with Muskogee Avenue (a/k/a, NS 4150 Road).
  2.  NS 4140 Road, from its intersection with EW 530 Road, to its intersection with EW 520 Road.
  3. ` EW 530 Road, from its intersection with Red Oak Drive, to its intersection with Lakewood Drive.
  4.  EW 530 Road, from its intersection with the Burlington Northern and San Francisco Railroad (“BNSF”) right-of-way, to its intersection with State Highway 266.
  5.  State Highway 266, from its intersection with U.S. Highway I-44 (a/k/a, the Will Rogers Turnpike), to its intersection with the Verdigris River.
  6.  NS 4120 Road, from its intersection with EW 510 Road, to its intersection with EW 530 Road.
  7.  EW 540 Road, from its intersection with U.S. Highway 66, to its intersection with NS 4120 Road.
