The above stated Defendant will take notice that the Plaintiff, Bank of America, N.A., filed its Petition in Foreclosure in the District Court in and for Rogers County, State of Oklahoma, on the 11th day of June, 2012, against the above stated Defendant, and said Defendant must answer said Petition on or before the 11th day of February, 2013, or said Petition will be taken as true, and a judgment will be rendered in said action against the above named Defendant, foreclosing her interest in the following described real estate, to wit:

THE FOLLOWING DESCRIBED REAL PROPERTY AND PREMISES SITUATE IN ROGERS COUNTY, STATE OF OKLAHOMA, TO-WIT:

A TRACT OF LAND IN THE WEST HALF OF NORTHWEST QUARTER OF THE NORTHWEST QUARTER (W/2 NW/4 NW/4) DESCRIBED AS: BEGIN 396 FEET NORTH OF THE SOUTHWEST CORNER OF SAID TRACT; THENCE NORTH ON WEST LINE THEREOF, 385 FEET; THENCE EAST 150 FEET; THENCE SOUTHEASTERLY ON A STRAIGHT LINE TO A POINT 415.7 FEET EAST OF THE POINT OF BEGINNING; THENCE WEST PARALLEL TO THE SOUTH LINE OF SAID WEST HALF OF NORTHWEST QUARTER OF NORTHWEST QUARTER (W/2 NW/4 NW/4) 415.7 FEET TO THE POINT OF BEGINNING, OF SECTION THIRTY-THREE (33), TOWNSHIP TWENTY-ONE (21) NORTH, RANGE SIXTEEN (16) EAST, ACCORDING TO THE U.S. GOVERNMENT SURVEY THEREOF, ROGERS COUNTY, OKLAHOMA.

TOGETHER WITH ALL THE IMPROVEMENTS THEREON AND THE APPURTENANCES THEREUNTO BELONGING, AND WARRANT THE TITLE TO THE SAME.

And a judgment will be rendered on the promissory note against the DEFENDANT(S), Unknown Spouse of Shirley I Whitworth AKA Shirley Whitworth, adjudging that default has been made in said note and mortgage, and that Plaintiff has a valid, prior and superior mortgage lien on said real estate in the total principal amount of $112,083.00, with applicable interest at six and five hundredths percent (6.5%), late charges as provided in the note, and any amounts which Plaintiff may be required to advance for payment of taxes, insurance or preservation of the subject property, together with costs of this action, for all of which judgment will be taken.  A judgment will be rendered against Defendant(s) Unknown Spouse of Shirley I Whitworth AKA Shirley Whitworth, adjudging any right, title or interest in and to the subject property claimed by said Defendant to be junior and inferior to the mortgage lien and judgment of Plaintiff, and that upon confirmation of such sale, all Defendants herein, and all persons claiming by, through or under them since the commencement of this action be forever barred, foreclosed and enjoined from asserting or claiming any right, title, interest, estate or equity of redemption in or to said premises, or any part thereof.
