PERRY TRUST, ITS’ UNKNOWN SUCCESSORS, HEIRS, EXECUTORS, ADMINISTRATORS, DEVISEES, TRUSTEES AND ASSIGNS, JOHNNY R. PERRY, HIS UNKNOWN SUCCESSORS, HEIRS, EXECUTORS, ADMINISTRATORS, DEVISEES, TRUSTEES AND ASSIGNS, LINDA J. PERRY, FORMER WIFE OF JOHNNY R. YOU AND EACH OF YOU are hereby notified that the above named Plaintiff has filed a lawsuit in the above Court alleging that Lynette R. Perry, Lynette R. Perry Trust, Johnny R. Perry, Linda J. Perry, former wife of Johnny R. Perry, Linda Sharon Skolnick, and Judith Elizabeth Alloway have previously asserted an interest in and to the following described real property situated in Rogers County, Oklahoma, to wit:

Lot 4, LESS, the North 16.5 feet of the South 33 feet thereof; and the South 14 rods of Lot 3; and the N/2 of SE/4 of SW/4; and the South 14 rods of S/2 of NE/4 of SW/4, all in Section 18, Township 24 North, Range 17 East of the I.B.&M., Rogers County, Oklahoma, according to the U.S. Government Survey thereof, LESS AND EXCEPT an undivided one-half of the minerals in and under said lands and which minerals have heretofore been sold and are not owned by the grantor; and LESS AND EXCEPT that part thereof hereby reserved by Grantor’s predecessor, to-wit: A part of Lot 4, Section 18, Township 24 North, Range 17 East of the I.B.&M., Rogers County, Oklahoma, described as follows: Beginning at a point on the west line of said Lot 4, said point being 33 feet North of the SW corner thereof; thence North along said west line of Lot 4 a distance of 736.5 feet; thence East, parallel with the south line of said Lot 4, a distance of 525 feet; thence South to a point which is 515 feet East and 33 feet North of said SW corner of Lot 4;  thence West, parallel with the south line of Lot 4, a distance of 515 feet to the point of beginning, including the waterline and facilities that furnish water utility service to the home on the above described land and an easement on and under the land where said waterline is located of sufficient width for maintenance purposes, which waterline connects with the water supply line of Rogers County Water District No. 1 along the South boundary line of Section 18, and somewhat parallels the Easterly boundary line of the above-described tract of land, and which waterline easement and facilities are an appurtenant to the homeplace description reserved by the Grantor’s predecessor.

That Plaintiff Tanayia I. Hubler, is the owner of said real property and is in the actual and peaceable possession thereof.  The Plaintiff is asking that the title of owner of said property be quieted as against the Defendants in this proceeding.

That said Defendants must answer the Petition filed by the Plaintiff on or before the 8th day of May, 2013, or the Petition will be taken as true and judgment rendered adjudging and decreeing Tanayia I. Hubler to be the owner of said real property and entitled to possession thereof and that the Defendants have no right, title, or interest therein and quieting the title to said real property.
