NOTICE OF HEARING
NOTICE IS HEREBY GIVEN that BNSF Railway Company (“Applicant”) filed an Application with the Corporation Commission of Oklahoma on April 5, 2013, requesting an order to install pedestal-mounted flashing light signals with gate arms utilizing prediction circuitry (the “Improvements”) at County Road NS-424 (#668-525R) (the “Crossing”), near Chelsea, Rogers County, State of Oklahoma.
It appears that the interest of the public requires a hearing in said cause; therefore, the same should be referred to a Hearing Officer and set for hearing on the below-mentioned date.
IT IS THEREFORE ORDERED AND NOTICE GIVEN that this cause shall be referred to a Hearing Officer for taking of evidence, hearing, and reporting thereon to the Commission. Said cause shall be hard in the Hearing Officer’s Courtroom, First Floor, Courtroom B, Jim Thorpe Building, Oklahoma City, Oklahoma, on the 24th day of April, 2013, at 9:00 a.m..
IT IS FURTHER ORDERED that this Notice shall be published once each week for two consecutive weeks in a newspaper of general circulation in Rogers County, State of Oklahoma. Application will cause this notice to be served on the County Commissioners of Rogers County, Oklahoma, and that the cost of said Notice and mailing shall be at Applicant’s expense with proof of publication and Affidavit of Mailing filed with the Commission’s Secretary to become a part of the record herein.
IT IS FURTHER ORDERED that the Applicant and all other interested parties and interveners shall pre-file all exhibits not later than ten (10) days prior to the hearing of the cause.
NOTICE IS FURTHER GIVEN that after hearing the Commission will, regardless of the relief requested in the Application, issue such orders and grant such relief as it deems reasonable, fair, necessary proper, and equitable in the premises, whether or not specifically prayed for in the Application.
