ORDER AND NOTICE FOR SERVICE BY PUBLICATION

This matter comes on for consideration upon the Motion (Dkt.#8) of the Plaintiff, United States of America, acting on behalf of the Rural Housing Services, by Danny C. Williams, Sr., United States Attorney for the Northern District of Oklahoma, through Ryan L. Souders, Assistant United States Attorney, for service by publication upon the Defendants, The Unknown Heirs, Executors, Administrators, Devisees, Trustees, Successors and Assigns of James E. Fowler, Deceased, and Karen B. Fowler.

The Court finds, based upon sufficient evidence, that the Defendants’ whereabouts are unknown to the Plaintiff and after diligent effort cannot be ascertained; and that with due diligence service cannot be made upon the Defendants by any other method; and

It appearing that this is an action for foreclosure of a mortgage upon the following described property:

Lot 42 in Block 1 of SHEPHERD VALLEY ADDITION, a Subdivision in Section 1, Township 20 North, Range 15 East of the I.B.&M., Rogers County, Oklahoma, according to the recorded Plat thereof.

which property is located within the Northern Judicial District of Oklahoma and that said Defendants claim some right, title, or interest in said property and are proper and necessary parties.

IT IS HEREBY ORDERED that service be obtained upon said Defendants by publication of a copy of this Order and Notice once a week for six consecutive weeks in a newspaper of general circulation in Rogers County, State of Oklahoma,

IT IS FURTHER ORDERED that the above named Defendants shall plead or answer within twenty-one (21) days after the date of the sixth publication, referred to above, or in default thereof this Court shall enter judgment against said Defendants as prayed for in Plaintiff’s Complaint.
