THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
Notice is hereby given that on the 23 day of April, 2013, at 10:00 o’clock, A.M., located at 201 S. Cherokee Avenue, Claremore, Oklahoma, the undersigned Sheriff will offer for sale and sell for cash to the highest and best bidder, subject to real estate ad valorem taxes and superior special assessments, if any, the following described real property, to-wit
The W/2 of NE/4 of SE/4 and the W/2 of NW/4 of SE/4 and the NE/4 of NW/4 of SE/4 and the NE/4 of SW/4 LESS a tract of land more particularly described as follows: Commencing at the Northwest corner of the NW/4 of NE/4 of SW/4, thence S 00˚04’01” E along the West line of said NW/4 of NE/4 of SW/4, a distance of 310.0 feet to the point of beginning, thence continuing S 00˚04’01” E a distance of 300.0 feet, thence North 89˚55’59” E a distance of 290.4 feet, thence N 00˚04’01” W a distance of 300.0 feet, thence South 89˚55’59” W a distance of 290.4 feet to the point of beginning, all in Section 32, Township 24 North, Range 17 East of the I.B.&M., Rogers County, Oklahoma, according to the U.S. Government Survey thereof, and
Together with an easement being the South 15 feet of the N/2 of NW/4 of SW/4 and the North 15 feet of the S/2 of NW/4 of SW/4 and the West 30 feet of the NW/4 of NE/4 of SW/4 LESS the North 610 feet thereof, and the North 15 feet of the West 30 feet of the SW/4 NE/4 SW/4 in Section 32, Township 24 North, Range 17 East of the I.B.&M., Rogers County, Oklahoma, according to the U.S. Government Survey thereof,
said sale will be made pursuant to a Special Execution and Order of Sale issued out of the office of the Court Clerk in and for Rogers County, Oklahoma, and pursuant to judgment entered in the District Court in and for said County, State of Oklahoma, in Case No. CJ-2012-345, entitled RCB Bank, Plaintiff, vs. Timothy J. Smith, et al., Defendants, to satisfy:
FIRST: The costs of said action accrued and accruing; and
SECOND: To the payment of the amount of delinquent ad valorem taxes, if any, plus any accumulated interest, fees and costs due to the Treasurer of Rogers County, State of Oklahoma
THIRD: The judgment and first lien of the Plaintiff, in the sum of $61, 275.38, plus accrued interest thereon as of June 12, 2012 in the amount of $580.39 plus interest thereafter accrued and accruing at the per diem rate of $13.49737; costs of this action in the amount of $408.70 and a reasonable attorney’s fee in the amount of $2,000.00 and for the accruing costs of the action, as more fully set forth in the Judgment.
Persons or other entities having interest in the property, including those whose actual addresses are unknown and persons or other entities who have or may have unknown successors and such unknown successors are hereby notified are:
The property has been duly appraised in the sum of $65,000.00.
