Notice is given that on the 23 day of May, 2013, at 10:00 am, in the Court Room at the Sheriff’s office at 201 S. Cherokee, in the City of Claremore, Rogers County, Oklahoma, the Sheriff of said County will offer for sale and sell, with appraisement, for cash, at public auction, to the highest and best bidder, all that certain real estate in Rogers County, Oklahoma, to-wit:

A tract of land in the Southwest Quarter of the Southeast Quarter of the Northeast Quarter (SW1/4 SE1/4 NE1/4) of Section Fourteen (14), Township Twenty (20) North, Range Fourteen (14) East of the Indian Base and Meridian, Rogers County, State of Oklahoma, according to the U.S. Government Survey thereof, more particularly described as: Beginning at the Northwest corner of the SW1/4 SE1/4 NE1/4; thence East on the North line of the SW1/4 SE1/4 NE1/4 to the Northeast corner thereof; thence South on the East line of the SW1/4 SE1/4 NE1/4, 208.17 feet; thence West parallel to the North line of the SW1/4 SE1/4 NE1/4, 616.6 feet to the East line of County Road; thence Northwesterly along the East line of County Road to a point on the West line of said SW1/4 SE1/4 NE1/4 which point is 99.6 feet South of the Point of Beginning; thence North 99.6 feet on the West line thereof to the Point of Beginning.

subject to unpaid taxes, advancements by Plaintiff for taxes, insurance premiums, and expenses necessary for the preservation of the subject property, if any, said property having been duly appraised at $25,000.00.  Sale will be made pursuant to a Special Execution And Order Of Sale issued in accordance with judgment entered in the District Court of Rogers County, Oklahoma, in Case No. CJ-10-887, entitled The Bank of New York Mellon Trust Company, N.A. f/k/a The Bank of New York Trust Company, N.A., as successor-in-interest to JPMorgan Chase Bank, National Association, as trustee, Plaintiff, vs. Robert William Swets, Tammy Swets; Jane Doe a/k/a Krystal Nutter; State of Oklahoma, ex rel., Oklahoma Tax Commission; United States of America, ex rel., Internal Revenue Service; being all of the Defendants and persons holding or claiming any interest or lien in the subject property. Any sale of the subject property is subject under federal law to the United States’ statutory right of redemption, 28 U.S.C. Sec. 2410 (c).
