THE STATE OF OKLAHOMA TO: MARLON H. ADAMS, (Deceased) THE UNKNOWN SUCCESSORS OF MARLON H. ADAMS, (Deceased)
You are hereby notified that you have been sued in the District Court in and for Rogers County, Oklahoma, Case No. CJ-2013-291, wherein BOKF, N.A., a National Banking Association d/b/a Bank of Oklahoma, as Successor in Interest by Merger to Bank of Oklahoma, N.A. is Plaintiff, and you are Defendant and unless you answer the Petition of the Plaintiff filed against you on or before the 4th day of September, 2013, the allegations of said Petition will be taken as true and judgment rendered against you accordingly as prayed for, and any interest you have in said property will be foreclosed, and the Court will be asked to hold that the Plaintiff is the owner of the note and mortgage therein described covering the following described real property situated in Rogers County, Oklahoma, to-wit:
The NW/4 of NE/4 of NE/4, less and except the North 295.16 feet of the West 295.16 feet thereof, all in Section 28, Township 23 North, Range 17 East of the I.B.&M., Rogers County, Oklahoma, according to the U.S. Government Survey thereof.
Further, judgment is asked against the Defendant, Marlon H. Adams, that there is due and owing under said note the sum of $126,053.02, together with interest thereon at the rate of 6.0% per annum from October 1, 2012, until paid, plus $864.81 escrow deficiency, plus a reasonable attorney's fee, plus advances for taxes and insurance during the pendency of this action, and for foreclosure of first mortgage on the above described property herein,
Judgment is further asked that Marlon H. Adams (Deceased), died on or about December 13, 2012 and left surviving him as only known heir, his wife, Kathleen Adams. That she and the Unknown Successors of Marlon H. Adams (Deceased), should be cut off from claiming any right, title, claim, lien, or demand in said real property, and their interest foreclosed and all other proper relief.
