ORDINANCE NO. 2014-6

AN ORDINANCE APPROVING AND ADOPTING THAT CERTAIN “SECOND AMENDED FIRST SUPPLEMENTAL PROJECT PLAN” RELATING TO INCREMENT DISTRICT NUMBER ONE, CITY OF CLAREMORE, OKLAHOMA (BAKER HUGHES INCREMENT DISTRICT)”; AMENDING ORDINANCE NO. 2012-16 RELATING TO THE BAKER HUGHES INCREMENT DISTRICT; PROVIDING FOR SEVERABILITY; AND CONTAINING OTHER PROVISIONS RELATING THERETO.

WHEREAS, on November 5, 2012, the City Council of the City of Claremore, Oklahoma (hereinafter, the “City”) adopted Ordinance No. 2012-16 establishing “Increment District Number One, City of Claremore, Oklahoma” (hereinafter, the “Baker Hughes Increment District”), and approving that certain “First Supplemental Project Plan Relating to Increment District Number One, City of Claremore, Oklahoma (Baker Hughes Increment District)” (Hereinafter, the “First Supplemental Project Plan”) to provide financing assistance to the Claremore Public Works Authority, and

WHEREAS, on February 13, 2014, the Claremore Public School District (hereinafter, “CPSD”) requested that the City consider providing capital cost assistance to CPSD to offset the effects of the Claremore Industrial and Economic Development Authority’s (hereinafter, the “Authority”) use of tax increment financing within the Claremore Industrial Park; and

WHEREAS, the request of CPSD was referred to the City of Claremore Local Development Act Review Committee for its recommendations on CPSD’s request to modify the First Supplemental Project Plan and the Baker Hughes Increment District; and

WHEREAS, CPSD’s request has been incorporated into that certain “Second Amended First Supplemental Project Plan Relating to Increment District Number One, City of Claremore, Oklahoma (Baker Hughes Increment District)” dated March 1, 2014 (hereinafter, the “Second Amended Project Plan”), modifying certain of the terms of the First Supplemental Project Plan, as amended by that certain “First Amended First Supplemental Project Plan Relating to Increment District Number One, City of Claremore, Oklahoma (Baker Hughes Increment District)” (hereinafter, the “First Amended Project Plan”); and

WHEREAS, the Local Development Act Review Committee, representing each of the taxing jurisdictions in which the proposed district is located, as well as the public at large, has reviewed the Second Amended Project Plan and the modification of the related increment district in accordance with the criteria specified in the Local Development Act: and
