PUBLISHED IN THE CLAREMORE DAILY PROGRESS, CLAREMORE, OKLAHOMA, APRIL 20, 2014.

ORDINANCE 2014-8

AN ORDINANCE AMENDING THE PROVISIONS OF TITLE XI, CHAPTER 113 OF THE CITY OF CLAREMORE CODE OF ORDINANCES TO ALLOW A PERMIT FREE WEEKEND FOR RESIDENTIAL SALES.

THE CITY OF CLAREMORE HEREBY ORDAINS:

SECTION 1 That Claremore City Code Title XI, Chapter 113, Section 113.10, Residential Sales, Exemptions, is hereby amended as follows (all deletions are struck through and insertions underlined and italicized):

§ 113.10 EXEMPTIONS.

The provisions of this article shall not apply or affect the following:

(A) Persons acting pursuant to an order of a court of competent jurisdiction;

(B) Persons acting in accordance with their powers and duties as public officials;

(C) Duly licensed auctioneers selling at auctions; and

(D) Charitable organizations or persons, when the proceeds from the sale are used directly for charitable purposes and the goods or articles are not sold on a consignment basis.  Persons or organizations exempted under this section must obtain a license, but without payment of fee;

and

(D) Once annually, the City, through the City Manager or designee, may hold a permit-free weekend, during which weekend permits for residential sales are not required.  Sales held during the permit-free weekend shall not count against the total licenses granted for a property.  Signs will not be provided by the City, but all other terms and conditions regarding signs, including the number of signs allowed, removal of signs and the location of signs, remain in force and effect.

SECTION II.

REPEALER.  All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of any such conflict.

SECTION III.

SEVERABILITY.  If any section, sub-section, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion of this Ordinance.
