NOTICE OF SHERIFF’S SALE

Notice is given that on the 2 day of May, 2013, at 10:00 o’clock a.m., at the Rogers County Sheriff’s Office Courtroom, 201 South Cherokee Avenue, Claremore, Rogers County, Oklahoma, the undersigned Sheriff of said County will offer for sale and sell, with appraisement, for cash, at public auction, to the highest and best bidder, all that certain real estate in Rogers County, Oklahoma, to-wit:

A tract of land located in Lot 4 of Section 31, Township 20 North, Range 17 East of the Indian Base and Meridian, Rogers County, Oklahoma, more particularly described as follows:  Beginning at a point 330.49 Feet South of the Northwest corner of said Lot 4; Thence North 89˚56’ East a distance of 575.40 Feet; Thence South 00˚10’09” West a distance of 165.22 Feet; Thence South 89˚55’53” West a distance of 574.91 Feet; Thence North a distance of 165.24 Feet to the point of beginning

subject to unpaid taxes, advancements by Plaintiff for taxes, insurance premiums, and expenses necessary for the preservation of the subject property, if any, said property having been duly appraised at $32,500.00.

Sale will be made pursuant to order of sale issued in accordance with judgment entered in the District Court of Rogers County, Oklahoma, in Case Number CJ-2012-682, entitled Home Bank, Plaintiff vs. Scott P. Phillips and Becky S. Phillips, being all of the Defendants and persons holding or claiming any interest or lien in the subject property, to satisfy said judgment and lien in the principal sum of $15,232.12, plus accrued interest due thereon of $930.55 through September 26, 2012, plus interest due thereon from and after September 26, 2012, at the rate of 10.75% percent per annum, until paid; abstract expense of $1,025.00; late charges of $50.00; advances by Plaintiff for taxes, insurance premiums, or expenses necessary for the preservation of the subject property of $12.08 through August 27, 2012; unpaid open charges of $25.00; an attorney fee of $2,000.00, plus all subsequent advances by Plaintiff, if any, for taxes, insurance premiums, or expenses necessary for the preservation of the subject property; and for all costs of this action.

The balance, if any, to be paid to the Clerk of this Court to await the further order of the Court.
