NOTICE OF ALIAS SALE OF LAND UNDER EXECUTION
THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
Notice is hereby given that on the 18 day of June 2013, at 10:00 o’clock, A.M., Courtroom of the Sheriff’s Office at 201 S. Cherokee in Claremore, Oklahoma, the undersigned Sheriff will offer for alias sale and sell for cash to the highest and best bidder, subject to real estate ad valorem taxes, superior special assessments and all interest of record, if any, except the Mortgage and interests foreclosed herein on the following described real property, to-wit:
The North Half (N/2) of the North Half (N/2) of the Northwest Quarter (NW/4) of the Southwest Quarter (SW/4) of the Southeast Quarter (SE/4) of Section Twenty-seven (27), Township Twenty-two (22) North, Range Fourteen (14) East of the I.B.&M., Rogers County, State of Oklahoma, according to the U.S. Government Survey thereof, commonly known as 13824 N. 155th East Ave., Owasso, OK 74055 (the “Property”)
Alias sale will be made pursuant to a Special Execution and Order of Alias Sale issued out of the office of the Court Clerk in and for Rogers County, Oklahoma, and pursuant to said judgment reserving the right of Plaintiff to recall said execution by oral announcement and/or order of the Court, prior to the alias sale, said judgment entered in the District Court in and for said County, State of Oklahoma, in Case No. CJ 2011-257, entitled Deutsche Bank National Trust Company on Behalf of the Certificate Holders of the Morgan Stanley ABS Capital I Inc., Trust 2005-NC2 Mortgage Pass-Through Certificates, Series 2005-NC2, Plaintiff v. Judith A. Warren and Robert C. Warren a/k/a Robert Warren, et al., Defendants, to satisfy:
FIRST: The costs of said action accrued and accruing;
SECOND: The judgment and first lien of the Plaintiff, Deutsche Bank National Trust Company on Behalf of the Certificate Holders of the Morgan Stanley ABS Capital I Inc., Trust 2005-NC2 Mortgage Pass-Through Certificates, Series 2005-NC2, in the sum of $194,081.29 with interest thereon at the rate of 9.05% per annum from October 1, 2008, as adjusted, if applicable, until paid; advances for taxes, insurance and preservation expenses, accrued and accruing; abstracting expenses, accrued and accruing; bankruptcy fees and costs, if any; and an attorney’s fee, plus costs, with interest thereon at the same rate, until paid.
Persons or other entities having interest in the property, including those whose actual addresses are unknown and persons or other entities who have or may have unknown successors and such unknown successors are hereby notified are: Judith A. Warren; Robert C. Warren a/k/a Robert Warren; Occupants of the Premises; Robert C. Warren Construction, LLC; First Bank & Trust Company, Bank of Oklahoma, N.A.; Hardesty Companies, Inc., d/b/a Mid-Continent Concrete Company; Robert E. Perry; Treasurer of Rogers County, State of Oklahoma; Board of County Commissioners of the County of Rogers, State of Oklahoma.
The property has been duly appraised in the sum of $200,000.00.
