ALIAS NOTICE OF SALE OF LANDS UNDER EXECUTION

STATE OF OKLAHOMA TO: SHARON J. SIMMS, a single person, and, MIDLAND FUNDING LLC, to all other persons claiming a lien or any interest in the property; and to the Public.

NOTICE IS HEREBY GIVEN that pursuant to a Writ of Execution issued out of the office of the Court Clerk in and for Rogers County, State of Oklahoma on the 7th day of August, 2013, in an action where BANCFIRST, Successor by merger to 1ST BANK OKLAHOMA, was Plaintiff; SHARON J. SIMMS, a single person, was the Defendant, commanding me to levy upon the property of the Defendant, SHARON J. SIMMS, a single person, sufficient to satisfy a judgment rendered in said action in favor of 1ST BANK OKLAHOMA, in the sum of Twenty-Four Thousand Five Hundred Twenty-Three and 18/100 Dollars ($24,523.18) to and including August 15, 2011, together with interest at the rate of 4.250% per annum, from and after August 15, 2011, until paid in full together with late fee of $80.00, abstracting in the amount of $415.00, reasonable attorney fees in the amount of $1500.00, and judgment for the costs of the action, accrued or accruing.

I have levied upon certain lands and tenements belonging to said Defendants, not exempt from sale under execution, and securing said sums, to-wit:

The W 1/2 of SW 1/4 of SE 1/4 of SE 1/4 of Section 16, Township 19 North, Range 17 East of the I.B.&M., Rogers County, Oklahoma, according to the U.S. Government Survey thereof;

situate in Rogers County, State of Oklahoma, and duly caused said lands, tenements and appurtenances to be appraised according to law at $20,000.00.

NOW, THEREFORE, notice is hereby given that pursuant to the commands of said writ, I will offer for sale for cash to the highest bidder, said lands, tenements and appurtenances or so much thereof as will satisfy said judgment and costs on the 19 day of September, 2013 at 10:00 o’clock a.m. of said day, at the Courtroom of Sheriff’s Office at 201 South Cherokee, City of Claremore, Rogers County, Oklahoma.
