Van Dyck ordered the the hearing be set for 1 p.m. on Tuesday in the District 3 Court Room on the fourth floor of the Rogers County Courthouse.
The hearing is open to the public and will set the date for the convening of the grand jury and the process for jury selection.
His amended motion was filed today changing the date from Oct. 18 to Oct. 15 at the request of District Attorney Janice Steidley and her asisstants Bryce Lair and David Iski.
The DA’s requested the hearing be rescheduled due to their attorney Joel Wholgemuth’s travel plans to Chicago.
The DA’s have a standing request with the Oklahoma Supreme Court to remove Judge Van Dyck from the proceedings, but no decision has been made at this time.
