BID #0446 - New Guardrail Cable Installed

GENERAL: The purpose of this Invitation to Bid (ITB) is to establish a contract for installation of new guard cable for Rogers County. Bid prices shall include all labor and materials necessary to perform the job in accordance with the standards of performance.

SPECIFICATIONS: All guard cables shall meet the requirements of National Cooperative Highway Research Program (NCHRP) Report 350 evaluation criteria for test level 3 traffic barrier. Traffic control must be established in accordance with the 2003 Edition of the Manual on Uniform Traffic Control Devices. New Guard Cables must be completed within 15 days.

QUANTITIES: Any quantities set forth in the Invitation to Bid are estimates. Contractor must furnish the quantity ordered whether more or less than the estimate.

DELIVERY: Rogers County request delivery within 30 days after receipt of order for new guard cable. If this delivery schedule cannot be met, bidder must state number of days/hours required to place commodity in County’s designated location. Failure to state delivery time obligates bidder to complete delivery by County’s requested date. Extended delivery dates may be considered when in the best interest of the County.

STANDARD OF PERFORMANCE: The Company shall perform according to the terms and conditions as stated herein, and according to the highest standards and commercial practices. Instances of poor performance by the Company will be documented and submitted to the Company for immediate review and corrective action. Continued poor performance will be deemed a breach of the specifications of the Invitation to Bid, and shall be grounds for immediate termination of the contract. A review meeting will be called between the Company and Rogers County when documented instances of poor performance occur. A plan for corrective action agreeable to both parties will be drafted and implemented. Rogers County retains the absolute right to assess whether and when performance is subsequently acceptable.

INDEMNIFICATION: The Company hereby agrees to assume all risks and responsibilities inherent in performing the contracted services and does hereby agree to defend, hold harmless, indemnify, release and forever discharge Rogers County and any of its officers, agents, employees, volunteers and servants from and against any and all claims, demands, and actions, causes of action, losses liabilities, or expenditures of any kind, including court cost and expenses, accruing or resulting from any suits or damages of any character resulting from injuries, damages, or death sustained by any person or persons, or property, by virtue of the performance of this agreement either directly or indirectly.

BONDS: All bids must contain a letter of intent from a bonding company authorized to do business in the State of Oklahoma stating its willingness to bond the Contractor pursuant to the terms of any contract resulting from the ITB.

• The contractor shall procure and maintain, at the Contractor’s expense, a Performance Bond for the period of the contract project, including any warranty period.

• This information shall be provided to Rogers County, not later than fifteen workdays, from the date of award of the term contract.

• The contractor is to supply Rogers County with evidence of having and maintaining proper and complete insurance, specifically Worker’s compensation in accordance with the laws of the State of Oklahoma, public liability and property damage insurance in the amount of $100,000.00

• All premiums and costs shall be paid by the Contractor.

• In no way will Rogers County be responsible in case of accident.

PERFORMANCE (BID) BOND: This information may be obtained from the Purchasing Agent, Marilynn Gibson, in the Rogers County Clerk’s Office, 219 South Missouri Avenue, Room 104, Claremore, Oklahoma, 74017. Telephone Number (918) 341-8360.

WARRANTY: Services received under this ITB shall be warranted for a period of not less than one year from the date of acceptance. Acceptance shall be in written form, signed and dated by both the receiving Rogers county Commissioner and the Contractor. The warranty shall include full repair or replacement against manufacturer’s defects, as directed by Rogers County. Guarantees and warranties should be submitted with the bid, as they may be a consideration in making an award.

ADDITIONAL REQUIREMENTS: No bid will be considered unless the firm submitting the bid meets the following conditions:

• Has in operation an organization including supervision, labor and equipment devoted to the type of work described in the proposal and specification.

• Has been engaged in the type of work described in the proposal and specification for a period of two (2) years.

• Contractor shall view project and confer in person with the County Commissioner(s) or their designee and obtain attestation of contractors’ appearance at the project prior to bid.

Purchases by Rogers County, Oklahoma are not subject to State or Federal Taxes.

Oklahoma Law requires each bidder submitting a bid to Rogers County for goods or services to furnish a notarized sworn statement of non-collusion.

Late bids will not be considered. Bids must be received in sealed envelopes, (one to an envelope) with bid number and closing date written on the outside of the envelope.

Rogers County reserves the right to reject any and all bids, to accept in whole or in part, to waive any informalities, or technicalities in bids received, to accept bids on materials or equipment with variations from specifications in those cases where efficiency of operation will not be impaired and unless otherwise specified by the bidder, to accept any item in the bid.
