NOTICE OF SEIZURE AND INTENDED FORFEITURE

OF PROPERTY

THE STATE OF OKLAHOMA TO: Michael Matthew Daniels, and all other persons and entities claiming an interest in the above described property.

YOU ARE HEREBY NOTIFIED that Plaintiff, State of Oklahoma, ex rel. Gene Haynes, District Attorney, through the Police Department of the City of Catoosa, Rogers County, State of Oklahoma, has seized incident to a lawful traffic stop and arrest, and intends to forfeit in accordance with The Uniform Controlled Dangerous Substances Act, Title 63 O.S. §§ 2-101, et seq. (the Act) the following property, to wit:

One Thousand Two Hundred Forty-Four Dollars ($1,244.00) U.S. Currency (Defendant Property) for the reason that on February 23, 2006, at or near 19300 Timbercrest Circle and the westbound ramp to I-44 from 193rd East Avenue in the City of Catoosa, Rogers County, State of Oklahoma, said Defendant One Thousand Two Hundred Forty-Four Dollars ($1,244.00) U.S. Currency was in the possession and control of Michael Matthew Daniels and was furnished or intended to be furnished in exchange for the controlled dangerous substance marijuana in violation of the Act, and/or are proceeds traceable to such an exchange, and was used or intended to be used by Michael Matthew Daniels to facilitate the knowing and unlawful possession of marijuana with intent to sell, exchange, distribute, receive, deliver or use the same in violation of the Act, and was moneys, coin and currency found in close proximity to the controlled dangerous substance marijuana, which is a forfeitable substance under the Act. The owner, claimant or other party in interest of the Defendant property may file a verified answer to Plaintiff’s Notice of seizure and intended forfeiture and a claim to said Defendant property within the Office of the Court Clerk at the Rogers County Courthouse, 119 S. Missouri, Rm. 1-112, Claremore, Oklahoma 74017, and provide a copy of same to Plaintiff in care of the undersigned attorney, within forty-five (45) days after the mailing or publication or other service of this notice, after which time the Court upon request of Plaintiff shall hear evidence upon the fact of the unlawful use of said Defendant property and shall order the Defendant property forfeited to Plaintiff, if such fact is proven by a preponderance of the evidence pursuant to the Act.
