RESOLUTION NO. 2007-2

A RESOLUTION DIRECTING THE MAYOR TO REFER TO THE PEOPLE FOR THEIR APPROVAL OR REJECTION PROPOSED AMENDMENTS TO THE CHARTER OF THE CITY OF CLAREMORE, ROGERS COUNTY, STATE OF OKLAHOMA, DELETING THE REQUIREMENT THAT THE CITY COUNCIL APPROVE THE APPOINTMENTS BY THE CITY MANAGER FOR THE POSITIONS OF CITY CLERK AND CHIEF OF POLICE; CLARIFYING LANGUAGE TO SPECIFICALLY PROVIDE THAT THE CITY CLERK AND CHIEF OF POLICE SHALL PERFORM SUCH DUTIES AS ARE ASSIGNED BY THE CHARTER AND THE CITY MANAGER; AND DELETING THE PROVISION WHICH PROVIDES THE CITY COUNCIL MAY DIRECTLY ASSIGN DUTIES TO THE INDIVIDUALS HOLDING SAID POSITIONS; DELETING THE PROVISION WHICH ALLOWS THE CITY COUNCIL TO DIRECTLY AUTHORIZE THE APPOINTMENT, SUSPENSION, DEMOTION OR REMOVAL OF CITY EMPLOYEES; AND PROVIDING THAT THE CITY MANAGER AND NOT THE CITY COUNCIL, SHALL HAVE THE AUTHORITY TO DIRECTLY CREATE CITY DEPARTMENTS AND PRESCRIBE THEIR FUNCTIONS AND DUTIES FOR THE PROPER OPERATION OF THE CITY; AND PROVIDING FOR NOTICE OF ELECTION.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CLAREMORE:

SECTION 1; The Mayor of the City of Claremore, Oklahoma is hereby directed to call a special election to be held in the City of Claremore, Oklahoma, on the 3rd day of April, 2007, for the purpose of submitting the following amendments to the City Charter of the City of Claremore, Oklahoma, to the people of the City for their approval or rejection:

SECTION 2.08 CITY CLERK AND CHIEF OF POLICE

(A) The City Manager shall appoint a City Clerk. subject to the approval of the City Council. The City Clerk shall give notice of Council meetings to its members and the public, keep the journal of its proceedings and perform such other duties as are assigned by this Charter’ or the City Manger. or the City Council.

(C) The City Manager shall appoint a Chief of Police, subject to the approval of the City Council. The Chief of Police shall perform such duties as are assigned by this Charter - or the City Manger. or the City Council.

SECTION 2. The ballot for the proposed amendments to the City Charter of the City of Claremore, which are set forth in Section 1 of the Resolution, shall be in the following form:

PROPOSITION NO. 1

THE GIST OF THE PROPOSITION SHALL BE AS FOLLOWS:

This measure amends the City of Claremore’s City Charter. It provides that the appointment of the City Clerk and the Chief of Police by the City Manager shall not be subject to approval by the City Council. It also provides that the City Clerk and the Chief of Police shall perform such duties as are assigned by the Charter or the City Manager. It eliminates the provision which allows the City Council to assign duties directly to them.

SECTION 3: The Mayor of the City of Claremore, Oklahoma is hereby directed to call a special election to be held in the City of Claremore, Oklahoma, on the 3rd day of April, 2007, for the purpose of submitting the following amendments to the City Charter of the City of Claremore, Oklahoma, to the people of the City for their approval or rejection:

SECTION 3.04 POWERS AND DUTIES OF THE CITY MANAGER

(A) The City Manager shall be the chief administrative officer of the City, responsible to the Council for the administration of all City affairs placed in the City Manager’s charge by or under this Charter.

(B) The City Manager shall:

(1) Appoint and, when necessary for the good of the service, suspend, demote or remove any or all heads of administrative departments and other administrative officers and employees of the City, except as otherwise provided by this Charter. The City Manger or the Council by ordinance may authorize the head of a department, an officer or the head of an agency to appoint, suspend, demote or remove subordinates in such department, office or agency subject to such merit system regulations as the Council may ordain;

SECTION 4; The ballot for the proposed amendment to the City Charter of the City of Claremore, which is set forth in Section 3 of the Resolution, shall be in the following form;

PROPOSITION NO. 2

THE GIST OF THE PROPOSITION SHALL BE AS FOLLOWS:

This measure amends the City of Claremore’s City Charter by deleting the provision currently existing which allows the City Council to directly authorize the appointment, suspension, demotion or removal of employees who are subject to the supervision and control of the City Manager.

SECTION 5: The Mayor of the City of Claremore, Oklahoma is hereby directed to call a special election to be held in the City of Claremore, Oklahoma, on the 3rd day of April, 2007, for the purpose of submitting the following amendments to the City Charter of the City of Claremore, Oklahoma, to the people of the City for their approval or rejection:

SECTION 4.01 GENERAL PROVISIONS

(A) Creation of Departments. The City Council City Manager may establish City departments, offices or agencies in addition to those created by this Charter and may prescribed the functions of departments, office and agencies, except that no function assigned by this Charter to a particular department, office or agency may be discontinued or, unless this Charter specifically so provides, assigned to any other.

SECTION 6: The ballot for the proposed amendment to the City Charter of the City of Claremore, which is set forth in Section 5 of the Resolution, shall be in the following form:

PROPOSITION NO. 3

THE GIST OF THE PROPOSITION SHALL BE AS FOLLOWS:

This measure amends the City of Claremore’s City Charter by deleting the provision currently existing which allows the City Council to directly create City departments or agencies and to prescribed the functions of all departments and agencies. Instead this amendment provides that City Manager shall have such authority.

SECTION 7: Only the registered voters of the City of Claremore, Oklahoma, may vote on the propositions set forth above. The propositions must be individually approved by a majority of the voters voting on the propositions at the election. The Rogers County Election Board shall conduct the election, canvass the returns, and certify the result of each individual proposition to the City Council. The Rogers County Election Board shall be notified of the election by receipt of a copy of this Resolution.

SECTION 8: Absentee ballots shall be provided in accordance with the provisions of the general election laws of this state.
