Felony sexual battery charges were filed against a 46-year old Rogers County man this week.

Court records filed in the case report that officers were assigned to the Hard Rock Hotel and Casino "in reference to a rape that had just occurred."

The alleged victim told officers she met Servando Moncayo on the gaming floor and that she brought him upstairs to her room to meet a friend. She reports that her husband was in the room when they arrived but that he left shortly thereafter.

"She stated that they were all sitting and talking and then she blacked out," records show, adding that she found him "performing a sexual act" on her.

Records show she was attempting to fight him off when her husband entered the room.

"She stated her husband grabbed Servando and they began to fight," records show.

"While standing inside the hotel room I observed the bathroom that was attached to be in total disarray and part of the wall and toilet to be destroyed, along with blood on the floor," officers reported.

At the time of arrest bond was set at $100,500.

Mercado is being charged with sexual battery and malicious injury to property in Rogers County District Court.
