NOTICE OF SALE OF LAND UNDER EXECUTION

Notice is hereby given that on the 5 day of April, 2011, at 10:00 o’clock, A.M., in the Sheriff’s Courtroom at 201 South Cherokee, Claremore, Oklahoma, the undersigned Sheriff will offer for sale and sell for cash to the highest and best bidder, subject to real estate ad valorem taxed, superior special assessments and all interest of record, if any, except the Mortgage and interests foreclosed herein on the following described real property, to-wit:

TRACT 1

THE EAST 242 FEET OF NORTH 305 FEET OF NORTH HALF OF NORTH HALF OF SOUTHEAST QUARTER OF NORTHEAST QUARTER (N/2 N/2 SE/4 NE/4) OF SECTION THIRTY-FIVE (35), TOWNSHIP TWENTY-ONE (21) NORTH, RANGE FIFTEEN (15) EAST OF INDIAN MERIDIAN, ROGERS COUNTY, OKLAHOMA TOGETHER WITH A 25’ ROAD EASEMENT ALONG THE SOUTH SIDE OF SAID TRACT AND BEING A PART OF SAID N/2 OF N/2 OF SE/4 OF NE/4 FOR THE PURPOSE OF INGRESS AND EGRESS

and

THE NORTH HALF OF NORTH HALF OF SOUTHEAST QUARTER OF NORTHEAST QUARTER (N/2 N/2 SE/4 NE/4) OF SECTION THIRTY-FIVE (35), TOWNSHIP TWENTY-ONE (21) NORTH, RANGE FIFTEEN (15) EAST INDIAN BASE AND MERIDIAN, ROGERS COUNTY STATE OF OKLAHOMA, ACCORDING TO THE U.S. GOVERNMENT SURVEY THEREOF LESS AND EXCEPT THE EAST 542 FEET OF THE NORTH 305 FEET THEREOF

Sale will be made pursuant to a Special Execution and Order of Sale issued out of the Court Clerk in and for Rogers County, Oklahoma, and pursuant to said judgment reserving the right of Plaintiff, Arvest Bank to recall said execution by order of the Court prior to the sale, said judgment entered in the District Court in and for said County, State of Oklahoma, in Case No. CJ-2008-692 entitled Arvest Bank v. Michael Shayne Brown a/k/a Michael S. Brown and Amie Brown a/k/a Aimee Brown, husband and wife, Occupants of the Premises, and Deutsche Bank National Trust Company, Trustee, in Trust for the Registered Holders of Argent Securities Inc., Asset Backed pass-Trough Certificates Series 2005-W2, State of Oklahoma, ExRel., Oklahoma Tax Commission and The United States of America, Ex Rel., IRS to satisfy:

FIRST: The costs of said sale and the costs of said action:

SECOND: The judgment awarded the Plaintiff as to its First Cause of Action in the amount of $99,119.63 which includes the principal in the amount of $95,699.14 plus accrued interest in the amount of $3,344.49, plus interest a the per diem rate of $22.91 per day from and after July 10, 2008; plus post judgment from and after February 14, 2011, together with a reasonable attorney’s fee of $3,000.00, abstracting fees in the amount of $125.00, late charges, all advances for taxes, insurance premiums, property preservation expenses, and costs of this action until paid with interest;

FINALLY: and the residue, if any, to be paid into the court to await the further order of the Court or a Judge thereof.

Persons, or other entities having interest in the property, including those whose actual addresses are unknown and persons or other entities who have or may have unknown successors and such unknown and persons or other entities who have or may have unknown successors and such unknown successors are hereby notified are:

Michael Shayne Brown a/k/a Michael S. Brown, Amie Brown a/k/a Aimee Brown, husband and wife, and Deutsche Bank National Trust Company, Trustee, in Trust for the Registered Holders of Argent Securities Inc., Asset Backed pass-Trough Certificates Series 2005-W2, State of Oklahoma, ex rel., Oklahoma Tax Commission, The United States of America, Ex Rel, IRS.

Tract 1 has been duly appraised in the sum of $30,000.00.

Tract 2 has been duly appraised in the sum of $70,000.00.
