NOTICE OF SHERIFF’S SALE

Notice is hereby given that on the 5 day of April, 2011, at 10:00 a.m. in the Courtroom of the Rogers County Sheriff’s Office in the City of Claremore, State of Oklahoma, the undersigned Sheriff of said County will offer for sale and sell for cash at public auction to the highest bidder, with appraisement, all that certain real estate and improvements thereon situated in Rogers County, Oklahoma:

Tract 1: THE SOUTH HALF OF THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER (S2 SW NE NE), AND THE NORTHWEST QUARTER OF THE SOUTHEAST QUARTER OF THE NORTHEAST QUARTER (NW SE NE), AND THE EAST HALF OF THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER (E2 SW NE), AND THE WEST HALF OF THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER (W/2 SW NE); AND THE NORTH HALF OF THE SOUTHEAST QUARTER (N2 SE) OF SECTION 9 IN TOWNSHIP 21 NORTH, RANGE 15 EAST OF THE IB&M, ROGERS COUNTY, OKLAHOMA

(“Mortgaged Property”), subject to any ad valorem real property taxes and improvements and/or assessments authorized by law.

Sale will be made pursuant to a Special Execution and Order of Sale issued upon a judgment filed February 16, 2011, in the District Court of Rogers County, Oklahoma, in Case No. CJ-2010-549 to satisfy first: the cost of the action, including Sheriff’s cost and cost of sale; second: the ad valorem taxes due and owing on the Mortgage Property, plus interest accrued and penalties, if any third: judgment of Arvest Bank, against the Defendant, Douglas M. Smith, Jr., in the amount $302, 613.40, with interest accruing from July 14, 2010, at the rate of 6.0% per annum until paid; the costs of this action in the sum of $821.36 and accruing; abstracting costs in the sum of $606.00 and accruing; process service fees in the sum of $462.00, accruing property preservation costs, property taxes and insurance premiums if any, and a reasonable attorney’s fee in the sum of $3,000.00; and, fourth: the balance, if any, will be paid into this Court to abide further order of the Court.

The Mortgaged Property has been duly appraised in the sum of: $327, 000.00.
