NOTICE OF SALE OF LANDS UNDER EXECUTION
STATE OF OKLAHOMA TO: PAUL F. BEMIES and TAMMY R. BEMIES, husband and wife, and, to all other persons claiming a lien or any interest in the property; and, to the Public.
NOTICE IS HEREBY GIVEN that pursuant to a Writ of Execution issued out of the office of the Court Clerk in and for Rogers County, State of Oklahoma, on the 14th day of December, 2010, in an action where 1st BANK OKLAHOMA, was Plaintiff; PAUL F. BEMIES and TAMMY R. BEMIES, husband and wife, were Defendants, commanding me to levy upon the property of the Defendants, PAUL F. BEMIES and TAMMY R. BEMIES, sufficient to satisfy a judgment rendered in said action in favor of 1ST BANK OKLAHOMA, in the sum of Four Hundred Twelve Thousand Two Hundred Thirty –Six and 07/100 Dollars ($412,236.07) plus a negative escrow balance of Two Thousand Six Hundred Sixty-Seven and 73/100 Dollars ($2,667.73) for a total due of Four Hundred Fourteen Thousand Nine Hundred Three and 80/100 Dollars ($414,903.80) to and including June 1, 2010, until paid in full, together with interest thereon at the rate of 5.375% per annum, from and after June 1, 2010, and late charges due and uncollected in the amount of $350.25, abstracting in the amount of $350.00, reasonable attorney fees in the amount of $2,500.00, and judgment for the costs of the action, accrued or accruing; and, to satisfy a judgment rendered in said action in favor of 1ST BANK OKLAHOMA, in the sum of Two Hundred Forty-Four Thousand Seven Hundred Twenty and 36/100 Dollars ($244,720.36) to and including July 11, 2010, until paid in full, together with interest thereon at the rate of 6.250% per annum, from and after July 11, 2010, and late charges due and uncollected in the amount of $323.94 reasonable attorney fees in the amount of $2,500.00, and judgment for the costs of the action, accrued or accruing.
I have levied upon certain lands and tenements belonging to said Defendants, not exempt from sale under execution, and securing said sums, to-wit:
A tract of land in the SE 1/4 of SE 1/4 of Section 15, Township 20 North, Range 16 East of the I.B.&M., Rogers County, Oklahoma, described as follows: Commencing at the Southeast corner of said Section 15; thence North 378.73 feet to the true point of beginning; thence S. 90˚00’00” W. a distance of 300 feet; thence N. 26˚10’48.8” W. a distance of 518.991 feet; thence N. 10˚38’51” E. a distance of 166.977 feet; thence N. 90˚00’00” E. a distance of 498.125 feet; thence S. 00˚00’00” W. a distance of 629.85 feet to-the point of beginning;

all situate in Rogers County, State of Oklahoma, and have duly caused said lands, tenements and appurtenances to be appraised according to law at $600,000.00.
NOW, THEREFORE, notice is hereby given that pursuant to the commands of said writ, I will offer for sale for cash to the highest bidder, said lands, tenements and appurtenances or so much thereof as will satisfy said judgment and costs on the 10 day of February, 2011 at 10:00 o’clock a.m. of said day, at the Courtroom of Sheriff’s Office at 201 South Cherokee, City of Claremore, Rogers County, Oklahoma.
