NOTICE OF HEARING BY PUBLICATION
THE STATE OF OKLAHOMA, TO: NATHAN EUGENE SMITH, or any other person alleging to be the natural father of Cameron Isaac Bozzell, whereabouts unknown.
On the 8th day of December, 2010, a Petition was filed in this Court for the Adoption of Cameron Isaac Bozzell, a minor child, and an Application has been filed to allow the adoption without the consent of the natural father and said Application is set for hearing on the 10th day of March, 2011, at the hour of 1:00 o’clock p.m. in the District Courtroom of the Honorable Judge Crosson, Judge of the District Court in Rogers County, Claremore, Oklahoma.
Petitioners have alleged in their Petition and Application that, pursuant to 10 O.S. § 7505-4.1 and 7505-4.2 said child is eligible for adoption because Nathan Eugene Smith willfully failed and refused to contribute to the support of the mother during the pregnancy and provide support for said child preceding the filing of the Petition herein, according to said natural father’s means, earning capacity and financial ability. That no other person is known who would have any duties, rights, or benefits to the minor child as the natural father.
That the child was born out of wedlock, that the Petitioner, Sarah Houston, is the natural mother of said child while Christopher Houston is the step-father to said child; that, pursuant to 10 O.S. § 7505-4.2; that the consent of the said Nathan Eugene Smith to this adoption is not required; and that it is in the child’s best interest that this Court grant the adoption as herein prayed.
YOU ARE, THEREFORE, NOTIFIED THAT THE COURT WILL HEAR EVIDENCE IN SUPPORT OF AND IN OPPOSITION TO THE GRANTING OF THE APPLICATION AT THE TIME AND PLACE ABOVE SHOWN WHERE YOU WILL HAVE THE RIGHT TO BE PRESENT AND AN OPPORTUNITY TO BE HEARD AT SAID TIME AND PLACE, INCLUDING THE RIGHT TO OBJECT TO THE ADOPTION FOR SAID CHILD. YOUR FAILURE TO APPEAR AT SAID HEARING SHALL CONSTITUTE A DENIAL OF YOUR INTEREST IN THE CHILD, WHICH DENIAL MAY RESULT, WITHOUT FURTHER NOTICE OF THIS PROCEEDING OR ANY SUBSEQUENT PROCEEDINGS, IN SAID CHILD’S ADOPTION WITHOUT YOUR CONSENT, THEREBY ULTIMATELY TERMINATING YOUR RIGHTS TO SAID CHILD IF ANY EXISTS, IN ACCORDANCE WITH THE LAWS OF THE STATE OF OKLAHOMA.
The Court has previously exercised due diligence in locating the purported natural father, but in seven (7) years has been unable to do so and Notice by Publication per statute is approved.
